Nakamura Swimming is committed to protecting the privacy of our students and guardians. This policy describes how we collect, use, and safeguard your personal information when using our website and services in Orlando, FL.
1.1 Information We Collect
We collect data necessary to provide professional swimming lessons, including:
Guardian Data: Name, email, phone number (SMS/WhatsApp), and payment information.
Student Data: Name, date of birth, aquatic skill level, and health conditions (via the registration form/waiver).
Location Information: Home address for at-home lessons (Home Visits).
1.2 How We Use Your Information
Your data is used to:
Process enrollments and scheduling.
Communicate schedule changes, safety notices, and promotions.
Process payments and issue invoices.
Ensure safety during lessons through the student's health history.
1.3 Sharing with Third Parties
We do not sell your data. We only share information with:
Management Platforms: Wix (hosting) and partner scheduling systems.
Partner Facilities: Gyms (LA Fitness, Crunch, NTC) only when necessary for student access to the premises.
Government Agencies: For Step Up For Students beneficiaries, for the purpose of verification and reimbursement.
1.4 Security and Storage
Data is stored on secure servers. We recommend that students/guardians keep their login credentials confidential.
2. TERMS OF SERVICE, RETURN & REFUND POLICY

By hiring the services of Nakamura Swimming, the client fully accepts the following conditions:
2.1 Evaluation Lessons
A technical evaluation lesson is mandatory for all new students.
The evaluation fee (as per current pricing) may be applied as a credit toward the enrollment fee if the student signs up for a plan immediately following the evaluation.
2.2 Cancellation and Rescheduling Policy (The 24-Hour Rule)
This is a fundamental rule of our scheduling process:
Prior Notice: Cancellations or rescheduling requests must be made at least 24 hours in advance.
Late Cancellation: Notices given less than 24 hours before the scheduled lesson will result in the forfeiture of the lesson, with no right to a make-up class or credit.
No-Show: If the student is absent at the scheduled time without prior notice, the lesson will be charged in full.
2.3 Weather Conditions (Rain and Lightning)
For Home Visits or outdoor pools:
Safety is our priority. In the event of storms or lightning, the lesson will be interrupted or canceled.
Credits: Lessons canceled by the instructor due to weather will be converted into credits for the following month. We do not issue cash refunds for weather-related cancellations.
2.4 Payments and Invoices
New Students: Enrollment fees and the first package/monthly fee must be paid in full prior to the start of lessons.
Existing Students: Invoices are sent at the end of each month and must be settled by the due date.
Credit Card Fees: In the event of a refund requested due to a client's error in plan selection, the credit card processing fees are non-refundable.
2.5 Step Up For Students Program
It is the sole responsibility of the parent/guardian to ensure the student is active in the system and that funds are available on the platform (EMA/MyScholarshop).
If the program does not authorize payment, the guardian is responsible for the full cost of the lessons provided.
2.6 Liability and Waiver
Digital signature of the Waiver (Release of Liability) is mandatory before the first lesson.
For Home Visit lessons, a responsible adult (18+) must be present at the residence during the entire duration of the lesson.
2.7 Refund Policy
Lesson packages are final. In the event of student withdrawal before the end of a package, the amount paid is non-refundable. Under exceptional circumstances and upon review, the balance may be transferred to another family member or held as a credit for a limited time.
